Introduction

The protection of personal data is an increasingly important issue in today’s society. The laws and regulations governing the collection, use and storage of data are constantly evolving.

Bill 25 in Quebec

In Quebec, Bill 25 is a law relating to the protection of personal information. It was passed in 2020 and will come into force in 2023. This Act was created to protect individuals’ personal data that is stored and processed by organisations. It aims to ensure that organisations respect individuals’ rights to privacy.

The Data Protection Officer

Bill 25 requires all organisations in Quebec that process personal information to appoint a Data Protection Officer. Regardless of size, resources or sector of activity, any business that processes personal data is obliged to appoint a Data Protection Officer. If no one has been appointed or delegated within your organisation, the person holding the highest authority is automatically designated as the Data Protection Officer by default. It is therefore important to identify someone within the organisation who is comfortable with these concepts and to whom this responsibility can be delegated.

Qualifications of the Data Protection Officer

Unlike other laws or legislative frameworks, Bill 25 does not prescribe any specific qualifications or certifications for the Data Protection Officer. However, it is always preferable to have someone with a basic level of knowledge in this field. It is also important to note that the officer may be someone from outside the organisation or an employee of the organisation.

Duties of the Data Protection Officer

The Act sets out certain duties that must be carried out by the Data Protection Officer, including establishing policies and procedures to protect personal data, training employees on privacy issues, and responding to requests for access to and correction of personal data. The officer must also be able to report data breaches to the Commission d’accès à l’information du Québec.

Complying with Bill 25 for Ethical and Effective Marketing

In conclusion, with Bill 25 coming into force in 2023, this represents a major change for all organisations in Quebec that process personal information. It aims to protect individuals’ privacy whilst ensuring that businesses can continue to operate effectively and ethically.
